Welcome to DubCam. These Terms of Service ("Terms") govern your access to and use of the DubCam mobile application and services (the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using DubCam, you agree to these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree, do not use the Service.

We may modify these Terms at any time. We will notify you of material changes. Your continued use after such changes constitutes acceptance of the modified Terms.

2. Eligibility

You must be at least 13 years old to use DubCam. If you are under 18, you must have permission from a parent or legal guardian. By using the Service, you represent that you meet these requirements.

3. Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

You may not use another person's account without permission or transfer your account to another person.

4. Service Description

DubCam is a platform that enables content creators (athletes, teams, and sports organizations) to:

  • Live stream content to their supporters
  • Build and monetize their fanbase through paid subscriptions
  • Share exclusive content with paying supporters
  • Engage directly with fans through comments and interactions

Supporters can subscribe to creators to access exclusive live streams and content.

5. Revenue Sharing and Payments

5.1 Creator Revenue

Creators earn 50% of subscription revenue from their supporters. DubCam retains 50% to cover platform costs, payment processing, infrastructure, and operations.

5.2 Payment Processing

All payments are processed through third-party payment processors (Stripe, Apple Pay). You agree to comply with their terms and conditions.

5.3 Subscription Terms

  • Subscriptions are billed monthly on a recurring basis
  • Subscriptions automatically renew unless canceled
  • You can cancel at any time; cancellation takes effect at the end of the current billing period
  • No refunds for partial months or unused subscription time

5.4 Pricing Changes

We reserve the right to change subscription prices. You will be notified of price changes in advance. Continued use after the change constitutes acceptance.

5.5 Taxes

You are responsible for all applicable taxes related to your use of the Service.

6. Content

6.1 Your Content

You retain ownership of content you create, upload, or share ("Your Content"). By posting Your Content, you grant DubCam a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, and display Your Content in connection with operating and promoting the Service.

6.2 Content Restrictions

You may not post content that:

  • Violates any law or regulation
  • Infringes on intellectual property rights
  • Contains hate speech, harassment, or threats
  • Is sexually explicit or pornographic
  • Promotes violence or illegal activities
  • Contains malware or phishing attempts
  • Violates others' privacy or publicity rights
  • Is spam or deceptive

6.3 Content Moderation

We reserve the right to remove content that violates these Terms or is otherwise objectionable. We may, but are not obligated to, monitor or review content.

6.4 Copyright Infringement

7. Prohibited Conduct

You may not:

  • Violate any laws or regulations
  • Impersonate others or provide false information
  • Harass, bully, or threaten others
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to accounts or systems
  • Use automated systems (bots, scrapers) without permission
  • Reverse engineer or attempt to extract source code
  • Collect user information without consent
  • Engage in fraudulent activities
  • Resell or redistribute the Service

8. Intellectual Property

The Service, including its design, features, graphics, and software, is owned by DubCam and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

"DubCam" and our logo are trademarks of DubCam. You may not use our trademarks without prior written consent.

9. Third-Party Services

The Service may integrate with or link to third-party services (payment processors, social media platforms). We are not responsible for third-party services and their terms apply to your use of them.

10. Termination

10.1 By You

You may terminate your account at any time through the app settings or by contacting us.

10.2 By Us

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any reason at our discretion. We will provide notice when possible.

10.3 Effect of Termination

Upon termination, your right to use the Service ends. We may delete your content and account information. Provisions that should survive (payment obligations, disclaimers, limitations of liability) will continue to apply.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Defects will be corrected
  • The Service is free of viruses or harmful components
  • Results from using the Service will be accurate or reliable

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DUBCAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify and hold harmless DubCam and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another
  • Your Content

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law provisions.

14.2 Arbitration

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration, except you may assert claims in small claims court if they qualify. You waive the right to a jury trial or to participate in a class action.

14.3 Exceptions

Either party may seek injunctive relief in court to protect intellectual property rights or prevent unauthorized use of the Service.

15. General Provisions

15.1 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and DubCam.

15.2 Waiver

Our failure to enforce any provision does not constitute a waiver of that provision.

15.3 Severability

If any provision is found invalid or unenforceable, the remaining provisions continue in full force.

15.4 Assignment

You may not assign these Terms without our consent. We may assign these Terms without restriction.

15.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.
